Mediation Advocacy Guidelines
- The negotiated outcome of a dispute is usually more satisfactory, more effective, more workable, more flexible and more durable than a decision taken by a court or other body.
- The parties should be able to control the procedure and the results themselves.
- The parties should be assisted by their professional representatives and advisers to come to a solution that also reflects their true needs and interests.
- Parties should also be careful to help the counterparty to secure their needs while preserving their own needs.
